Before working with a real estate broker, you should know that...

The duties of a license holder who represents a party in a real estate transaction are:

• To negotiate on behalf of the party the license holder represents;
• To treat all parties honestly and provide accounting for all funds handled;
• To disclose to the party the license holder represents all known information about the property and the other party that may affect the decision to enter into the transaction.

A broker who acts as an intermediary (representing both parties) must obtain written consent from both parties, treat all parties honestly, and may not disclose confidential information without permission.

Types of Representation

• Agent / Broker representing the seller: owes the seller undivided loyalty, reasonable care, and obedience, and must keep the seller's confidential information.
• Agent / Broker representing the buyer: owes the buyer the same duties of loyalty, care, and confidentiality.
• Intermediary: a broker who represents both parties with their written consent.
